Terms of Service

The agreement between you and Luvarly for using Figsoul, in plain language. Please read it before you make your first soul.

About these terms

Figsoul is a service for creating AI characters, called souls, and rendering them in photos, looks and video clips. It is run by Luvarly, a company registered in the Netherlands, and when these terms say we or us, they mean Luvarly. These terms are the agreement between you and us for the Figsoul website and app, including features we add later unless they come with terms of their own.

By creating an account or using Figsoul, you accept these terms. Our Privacy Policy explains how we handle personal data. If you do not agree with these terms, do not use Figsoul.

Some rules differ for consumers and businesses. You are a consumer if you use Figsoul for purposes outside your trade, business or profession. If you use Figsoul for a business, you accept these terms on behalf of that business and confirm that you may do so.

Who can use Figsoul

You must be at least 18 years old, or the age of majority where you live if that is higher. You may not use Figsoul where the law forbids it, or if we closed an earlier account of yours for breaking these terms.

Your account

  • One person, one account: an account is for one person. Do not share it, sell it, or make extra accounts to collect welcome credits or affiliate commissions.
  • Keep it secure: you sign in with a link or code we email you, or with Google. Keep your inbox and Google account safe, and tell us at support@figsoul.com straight away if you think someone else has access.
  • Accurate details: use an email address you own and can read. We send account and purchase messages to it.
  • Your responsibility: you are responsible for what happens through your account, including everything you render with it.

Souls and people’s likeness

A soul is a character you create from a description, from photos, or by remixing another soul. Figsoul keeps its face, hair and style the same across everything you render with it. Because a soul can look like a real person, these rules matter most:

  • Photos you upload: only upload photos of yourself, or of people who have given you their explicit permission to turn them into a soul and to render them the way you intend. You must be able to show that permission if we ask.
  • No one without consent: do not make a soul that looks like a real, identifiable person, including public figures and celebrities, unless that person has agreed.
  • No impersonation: do not use a soul to pretend to be a real person, or to make people believe something a real person did not say or do.
  • Garments, scenes and clips: only upload outfits, reference videos and other material you own or may use. A reference video for motion may show other people only with their permission.
  • Starter souls: the starter souls are fictional characters made by us. You may render and remix them, but not present them as real people.

Acceptable use

You may not use Figsoul to create, upload or share:

  • Sexual content involving minors, or any content that sexualizes someone who is or looks under 18.
  • Sexually explicit or nude content, of anyone. Figsoul is not for adult content.
  • Intimate or degrading images of a real person, or content that harasses, threatens, bullies or defames someone.
  • Content meant to deceive: fake news, political disinformation, fake reviews or endorsements, or fraud.
  • Content that promotes terrorism, violent extremism, self-harm or hatred against people for who they are.
  • Content that infringes someone else’s copyright, trademark, privacy or other rights.

You may also not:

  • Break the law, or help someone else break it.
  • Remove or hide the watermarks or provenance data that some models add to show that an image or clip is made by AI.
  • Disrupt or overload Figsoul, get around its security or credit limits, or copy, scrape or reverse engineer it, except where the law allows.
  • Resell access to Figsoul without our written permission.

The companies whose models render your work have their own rules, and your use must follow them too: OpenAI’s usage policies (opens in a new tab) for GPT Image, Google’s Generative AI Prohibited Use Policy (opens in a new tab) for Nano Banana, and the policies of Kuaishou (Kling), Alibaba (Wan) and ByteDance (Seedance). A model may refuse a request that breaks them; when it does, the credits come back.

To report content or use of Figsoul that you believe is illegal or breaks these terms, write to support@figsoul.com. We look into reports and suspected breaches, and may limit an account or remove content while we do. If we take action against your account, we tell you why, unless the law forbids it, and you can ask us to reconsider by replying.

AI output and models

Figsoul renders with AI models from other companies, run through fal, our rendering provider. Today those are GPT Image (OpenAI), Nano Banana (Google), Kling (Kuaishou), Wan (Alibaba) and Seedance (ByteDance), and we may add or change models. To render, we send fal what the model needs: your prompt, the soul’s images and any photo or clip you added. The Privacy Policy explains how that data is handled.

  • Output varies: AI models can produce results that look off, drift from the soul, or differ from what you asked. A render that fails gives its credits back; one that works but isn’t to your taste does not.
  • Say it’s AI: when you publish renders of a realistic person, label them as AI-generated wherever the law or the platform requires it. Under the EU AI Act, realistic images and video of people made by AI must be disclosed as such.
  • Not our views: what you render does not reflect our views and is not an endorsement by us.
  • Models change: model makers update and retire models. When a model changes, renders made with it later may look different.

Your content and ours

You keep the rights you have in what you put into Figsoul, such as your prompts, photos and clips, and in the souls and renders you make, as far as the law allows. AI output can resemble output made for others, and in many countries purely AI-made images have little or no copyright protection, so you may not have exclusive rights in them.

You allow us to store, process and send your content as far as needed to run Figsoul for you, including sending it to fal and the model makers to render. This permission ends when you delete the content or your account, except for copies the law requires us to keep.

Figsoul itself, including its software, design, starter souls, name and logo, belongs to Luvarly or our licensors. We give you a personal, non-exclusive right to use Figsoul under these terms, and no other rights in it.

Credits

Every render costs credits. The price shows on the button before you start, and the credits are taken when the render starts.

  • Welcome credits: a new account gets a one-time amount of free credits when it is first signed in to.
  • Packs: you buy credits in one-off packs. There is no subscription and nothing renews.
  • No expiry: credits you buy do not expire while your account is open.
  • Failed renders: if a render fails, its credits come back automatically. If a photo shoot returns fewer takes than you asked for, the difference comes back.
  • Prices: what a render costs depends on the tool, the model, the size and, for video, the length. We may change prices for future renders, never for one already started.
  • No cash value: credits cannot be exchanged for money, transferred to another account or sold, unless the law requires otherwise. The same goes for credits from the affiliate program.

Payments

  • Stripe: Stripe handles our payments. We never see or store your full card details.
  • Prices and tax: we show prices in US dollars. They include VAT where it applies.
  • Refunds and chargebacks: if we refund a payment, in full or in part, or you dispute it with your bank, the credits it bought, or the refunded share of them, are removed from your balance as far as they are unused. If a dispute is decided in our favour, the credits come back. If you think a charge is wrong, please write to support@figsoul.com first: we can usually sort it out faster than your bank.

Your right of withdrawal in the EU

If you are a consumer in the European Union or the European Economic Area, you normally have 14 days to withdraw from an online purchase without giving a reason. Credits are digital content that we add to your account the moment you pay, so at checkout we ask you to confirm two things: that you want the credits added straight away, and that you understand you lose your right of withdrawal once they are added.

  • Before the credits are added: if a payment is still processing, you can withdraw by writing to us before it completes.
  • After the credits are added: you cannot withdraw from that purchase, because you asked for the credits at once and confirmed what that means.
  • Faulty service: this does not affect your rights if Figsoul does not work as we promised. Tell us and we will put it right or refund you.
  • How to reach us: send a clear statement to support@figsoul.com, saying which purchase it is about. You do not need to use a form.

The affiliate program

Every account has an invite link. When someone creates a new Figsoul account through your link, you earn 20% of the credits in every pack they buy, for as long as both accounts exist. The buyer pays the normal price; the commission costs them nothing.

  • Paid in credits: commissions are Figsoul credits, not money. You can redeem them into your balance from 14 days after the purchase they come from. Once redeemed, they are credits like any other.
  • Who counts: only new accounts made through your link. Someone who already has an account cannot be added later, and an account can have only one referrer.
  • No self-referral: you may not earn on your own purchases, for example through a second account, or on accounts you control.
  • Promote fairly: do not spam, do not make claims about Figsoul that are untrue, do not pretend to be us, and do not bid on Figsoul’s name in search ads. Disclose that you earn a commission wherever the law or a platform requires it.
  • Withheld commissions: if a purchase is refunded, disputed or turns out to be fraudulent, its commission (or, for a partial refund, that share of it) is removed, also after it was redeemed where the credits are still unused. If a dispute is decided in our favour, it comes back. We may withhold commissions while we look into a breach of these rules, and remove them if one is confirmed.
  • Changes: we may change the program, its rate or its hold, or end it, and tell you at least 30 days before. Commissions you already earned stay redeemable.
  • Closing your account: unredeemed commissions lapse when your account is deleted.

Closing your account

You can stop using Figsoul at any time, and delete your account yourself in Settings. When your account is deleted, your souls and renders are deleted, unused credits and unredeemed commissions lapse without a refund, and you are signed out everywhere.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if your use puts Figsoul, other users or other people at risk. Where reasonable, we warn you first and give you a chance to fix the problem. We tell you why, unless the law forbids it.

If we close your account because you seriously broke these terms, unused credits lapse without a refund, unless the law requires one. If we close your account for any other reason, or stop offering Figsoul, we tell you at least 30 days in advance where we can and refund the credits you bought and did not use.

Availability and changes to Figsoul

We work to keep Figsoul running well, but we cannot promise that it is always available, fast or free of errors. We sometimes need maintenance, and services we rely on, such as fal and the model makers, can have outages.

Figsoul changes over time, and we may add, change or remove tools and models. Features we show as coming soon are not part of what you pay for until they are available.

Liability

As far as the law allows, Figsoul is provided as it is and as available. If you are a consumer, you keep your legal rights, including your right to a service that matches what we promised. Nothing in these terms takes away rights that consumer law gives you.

As far as the law allows, we are not liable for:

  • Indirect or consequential loss, such as lost profit, lost revenue, lost data or damage to reputation.
  • What you render and publish, and how others react to it.
  • Third-party services, including fal, the model makers, Stripe and the platforms you post on.
  • Loss caused by events outside our reasonable control.

Our total liability to you for all claims together is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to damage caused by our intent or gross negligence, to death or personal injury, or where the law does not allow liability to be limited.

You compensate us for claims by others, and the reasonable cost of handling them, that arise from content you uploaded or rendered in breach of these terms or the law, such as a soul made from someone’s likeness without their consent. If you are a consumer, this applies only as far as the law allows.

Governing law and disputes

Dutch law applies to these terms and to your use of Figsoul. Disputes go to the competent court in the Netherlands.

If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

If something goes wrong, tell us first at support@figsoul.com. Most problems are solved fastest that way.

Changes to these terms

We may change these terms, for example when Figsoul or the law changes. We tell you about material changes by email or in the app at least 30 days before they take effect. The date at the top of this page shows when the terms last changed.

If you do not agree with a change, you can delete your account before it takes effect. If the change is to your disadvantage, we refund the credits you bought and did not use. If you keep using Figsoul after that date, the new terms apply to you.

General

  • Whole agreement: these terms, the Privacy Policy and what you agree to at checkout are the whole agreement between you and us about Figsoul.
  • Separate parts: if a court finds part of these terms invalid, the rest stays in force.
  • No waiver: if we do not enforce a right straight away, we still have it.
  • Transfer: you may not transfer your account or these terms to someone else. We may transfer them to a company that takes over Figsoul. We tell you if we do, and it does not reduce your rights.
